MOFCOM Announcement No. 25 of 2016 on Midterm Review of Anti-dumping Measures Applicable to Imports of Photographic Paper Originated in FUJI FILM Manufacturing Europe B.V. and FUJI FILM Manufacturing U.S.A., Inc.

The Ministry of Commerce released Announcement No. 10 of 2012 on March 22, 2012, deciding to impose anti-dumping duties on imports of photographic paper originated in the EU, the U.S. and Japan since March 23, 2012. The rates of the anti-dumping duty applicable to FUJI FILM Manufacturing Europe B. V. and FUJI FILM Manufacturing U.S.A., Inc. were 17.5% and 16.2%, respectively.

On June 2, 2015, Lucky Film Co., Ltd. officially submitted an application to the Ministry of Commerce, claiming that, the dumping margin of exports of photographic paper by FUJI FILM Manufacturing Europe B. V. and FUJI FILM Manufacturing U.S.A., Inc. to China increased upon the final ruling, excessively beyond the anti-dumping duty rates determined in the final ruling, and requesting a mid-term review to be conducted on the anti-dumping measures applicable to the imports of photographic paper originated in FUJI FILM Manufacturing Europe B. V. and FUJI FILM Manufacturing U.S.A., Inc. in terms of the dumping and dumping margin.

The Ministry of Commerce reviewed the application from Lucky Film Co., Ltd., and considered that the conditions for case-filing were satisfied. In accordance with the Regulations of the People’s Republic of China on Anti-dumping and the Provisional Rules on Midterm Review of Dumping and Dumping Margin of the Ministry of Commerce, the Ministry of Commerce issued the announcement on case-filing on June 29, 2015, deciding to conduct a mid-term review on the anti-dumping measures applicable to the imports of photographic paper originated in FUJI FILM Manufacturing Europe B. V. and FUJI FILM Manufacturing U.S.A., Inc. in terms of the dumping and dumping margin. The scope of the review investigation included the normal value, export price and dumping margin of imports of photographic originated in FUJI FILM Manufacturing Europe B. V. and FUJI FILM Manufacturing U.S.A., Inc. The products under investigation during the review were the same as those in the original anti-dumping investigation, i.e. exposed photographic sensitive paper (“photographic paper”), which were listed under tariff codes 37031010, 37032010 and 37039010 in the Customs Import and Export Tariff of the People’s Republic of China. 

According to the results from the investigation of the dumping and dumping margin of imports of photographic originated in FUJI FILM Manufacturing Europe B. V. and FUJI FILM Manufacturing U.S.A., Inc., the Ministry of Commerce proposed to the Customs Tariff Commission of the State Council to change the rate of anti-dumping duty. In accordance with Article 50 of the Regulations of the People’s Republic of China on Anti-dumping and the Provisional Rules on Midterm Review of Dumping and Dumping Margin of the Ministry of Commerce, relevant matters are hereby announced as follows:

I. Ruling

Upon the investigation, the Ministry of Commerce determines that the dumping margins of FUJI FILM Manufacturing Europe B. V. and FUJI FILM Manufacturing U.S.A., Inc. are 23.5% and 23.6%, respectively.

II. Levy of Anti-dumping Duties

In accordance with the Regulations of the People’s Republic of China on Anti-dumping, the Customs Tariff Commission of the State Council decides that the rates of anti-dumping duty applicable to FUJI FILM Manufacturing Europe B. V. and FUJI FILM Manufacturing U.S.A., Inc. are adjusted to 23.5% and 23.6% from June 29, 2016.

III. Method to Levy Anti-dumping Duties 

Import operators shall pay related anti-dumping duties to the Customs of the People’s Republic of China when importing photographic paper originated in FUJI FILM Manufacturing Europe B. V. and FUJI FILM Manufacturing U.S.A., Inc. as of June 29, 2016. The anti-dumping duty shall be collected ad valorem on the basis of dutiable value authorized by Chinese Customs. The formula is: Anti-dumping duty= dutiable value authorized by the Customs x anti-dumping duty rate. Import VAT shall be collected ad valorem on the basis of dutiable value authorized by the Customs plus tariff plus anti-dumping duty.

IV. Administrative Reconsideration and Administrative Litigation 

In accordance with Article 53 of the Regulations of the People’s Republic of China on Anti-dumping, interested parties may apply for administrative reconsideration or institute legal proceedings in the people’s court. 

V. The Announcement shall come into force as of June 29, 2016.
